Terms and Conditions

These terms govern your use of the Polysetter website and platform ("Polysetter", "we", "us"). By creating an account, buying a challenge or otherwise using the platform, you agree to these terms. If you do not agree, do not use the platform.

  1. 01What Polysetter is — and what it is not

    Polysetter is a skills-evaluation service. You trade in a simulated environment on prediction-market data, and if you meet the published objectives you may be offered a funded account and contractual rewards based on the results you produce in that simulated environment.

    Polysetter is not a broker, dealer, exchange, clearing house, custodian or licensed investment firm. We do not hold your money for trading, do not execute orders on any live market, do not give you access to real capital and do not provide investment, financial, legal or tax advice. Nothing on the platform is an offer or solicitation to buy or sell any security, contract or other instrument.

  2. 02Eligibility

    You must be at least 18 years old and legally able to enter into a contract. You may not use the platform if you are located in, or a resident of, a jurisdiction where our service or prediction-market activity is restricted, or if you appear on any applicable sanctions list.

    You are responsible for complying with the laws that apply to you, including tax obligations arising from any reward you receive.

  3. 03Your account

    You must register with accurate information and keep it up to date. One person may hold one user account; you may not register on behalf of someone else, share credentials, or let another person trade your accounts.

    You are responsible for everything that happens under your account. Tell us immediately at support@polysetter.com if you suspect unauthorised access.

  4. 04Challenges, orders and fees

    Buying a challenge creates an order. An order is a record of your purchase; the challenge account itself is created after the order is confirmed. Prices, account sizes and fees are those shown at the time of purchase and may change for future purchases.

    A challenge fee is paid once per attempt. Any refund, credit or return of the fee happens only as described at the point of sale or in our refund policy — a failed evaluation does not by itself entitle you to a refund.

  5. 05Evaluation rules

    To pass an evaluation you must meet every objective published for your account at the time it was created — profit target, maximum daily loss, maximum overall loss, maximum risk per position, minimum trading days and any time limit. Breaching a loss or risk rule, or reaching the time limit without hitting the profit target, ends the evaluation as failed.

    Evaluation is performed on our side from the trading data we receive for your account. Where our records and any third-party display differ, our records govern. We may correct evaluation results affected by data errors, outages or manifest mistakes.

  6. 06Funded accounts and rewards

    Passing an evaluation may lead to a funded account. A funded account is also a simulated account: the balance shown is notional and you are not trading your own or anyone else's real capital.

    Rewards are contractual payments we make to you based on the simulated results of a funded account, subject to the profit split and payout terms in force. They are not trading profits, investment returns, salary or a share in any fund. Nothing guarantees that you will qualify for, or continue to hold, a funded account.

  7. 07Payout requests

    While a funded account is in profit you may request a payout. Requests are reviewed before approval, and we may ask for identity or tax documentation before paying. We may decline or adjust a request where the underlying activity breached these terms, where the results came from a platform or data error, or where payment would breach applicable law.

  8. 08Prohibited conduct

    You may not:

    • hold more than one user account, or coordinate accounts with other users to take opposite positions or to guarantee that one account passes
    • exploit errors, latency, stale prices, data outages or other defects of the simulated environment or its data sources
    • use manipulative, abusive or illegal strategies, or activity intended to distort the evaluation rather than to trade a genuine strategy
    • use automation, scraping, reverse engineering or any tool that interferes with the platform or its security
    • let anyone else trade your account, or sell, rent or transfer an account or its results
    • provide false information, impersonate anyone, or use the platform for money laundering or any unlawful purpose
  9. 09The simulated environment and third-party services

    The platform runs on a simulated trading environment and displays market names and prices from third-party sources. We are not affiliated with, endorsed by, or acting on behalf of those venues or providers, and we do not control their data or availability.

    The platform is provided on an "as is" and "as available" basis. Access may be interrupted for maintenance, incidents or third-party failures, and prices or positions shown may be delayed or incorrect. Where an outage or data error materially affects an evaluation, we may extend, reset or annul it.

  10. 10Intellectual property

    The platform, its content, branding and software belong to us or our licensors. You get a personal, non-transferable, revocable right to use the platform for its intended purpose. You may not copy, resell or create derivative works from it without our written permission.

  11. 11Suspension and termination

    You may stop using the platform at any time and ask us to close your account. We may suspend or terminate access, close accounts, cancel evaluations and withhold rewards where you breach these terms, where we reasonably suspect abuse or fraud, or where we are required to do so by law.

    Termination does not affect rights and obligations that accrued before it, including our right to reverse payments obtained in breach of these terms.

  12. 12Disclaimers and limitation of liability

    To the fullest extent permitted by law we exclude all warranties not expressly stated here, including any warranty that the platform will be uninterrupted, error-free or fit for a particular purpose, and any guarantee of results.

    To the fullest extent permitted by law, our total liability to you for all claims connected with the platform is limited to the fees you paid us in the twelve months before the event giving rise to the claim, and we are not liable for lost profits, lost opportunity, lost data or indirect or consequential loss. Nothing here limits liability that cannot be limited by law.

  13. 13Indemnity

    You agree to indemnify us against claims, losses and costs arising from your breach of these terms, your misuse of the platform, or your breach of any law or third-party right.

  14. 14Changes to the platform and to these terms

    We may add, change, suspend or withdraw features of the platform, including account sizes, fees and the objectives of future evaluations. Changes to the rules of an evaluation apply to evaluations started after the change; an evaluation already in progress keeps the objectives published when its account was created.

    We may also update these terms as the product and its regulation develop. We will post the updated version here with a new "last updated" date and, for material changes, give notice by email or in the platform. Continuing to use the platform after a change means you accept the updated terms.

  15. 15Communications

    We contact you by email at the address on your account and through notices in the platform; it is your responsibility to keep that address current and reachable. Service messages about your accounts, evaluations and payouts are part of the service and cannot be opted out of while your account is open — marketing messages can, at any time.

  16. 16General

    We may transfer our rights and obligations under these terms to another company; you may not transfer yours without our written consent. If any provision is found unenforceable, the rest stays in force. Not enforcing a right immediately does not waive it.

    These terms, together with our Privacy Policy and any rules published in the platform, are the whole agreement between us about your use of Polysetter, and they replace anything said earlier.
